With
more than 250 million passenger vehicles in the
U.S., it serves to reason that one of the most
common types of personal injury claims involve
individuals who have been injured in automobile
accidents. According to the National Highway
Transportation Safety Administration, there were
approximately 34,000 traffic fatalities in 2009
and approximately 5,300 motorcyclists killed on
the road in 2008.
A
driver is negligent if that driver fails to use
reasonable care while operating a motor vehicle.
With the growing use of cell phones and other
electronic devices, the issue of drivers being
“distracted” while operating a motor vehicle has
become a major safety concern. Distracted
driving occurs when anything takes a driver’s
eyes off the road, hands off the steering wheel,
or interrupts the driver’s concentration. The
most current statistics on distracted driving
reveal that nearly 6,000 people died and more
than 500,000 people were injured in automobile
crashes in 2008 as a result of a driver being
distracted. Texting while driving is against the
law in Illinois and Illinois has banned the use
of cell phones while driving in a school zone or
a highway construction zone.
Mr.
